First off, I would like to state that I am a one man business. Creating, ordering prints, shipping, packing, painting etc. is done all by myself.

This makes it very personal for me and therefore I am of course able to talk to you personally at ART@SIELART.COM if you have any questions.

The Terms of Service is for both of us to have a smooth sailing.

POLICY AND TERMS:

By placing an order at Sielart.com, you are responsible for original shipping charges, all applicable custom import fees and the cost of return shipping back to Siel-art. This also applies to any shipments that are refused by you at delivery.

ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE:

The services (the “Service”) offered at Sielart.com (the “Site”), which is owned and operated by Christophe Siel, the artist and creator of the artwork within the site, are provided to you under the terms and conditions of these Terms of Service and Use.

BY USING THE SERVICE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH HEREIN.

Please review the following terms carefully. If you do not agree to these terms, you should not obtain goods, products or services from this Site. The Terms of Service and Use outlined on this Site may be amended at any time by Christophe Siel without any specific notice to you. The latest and most current version of the Terms of Service and Use will be posted on this Site, and you should review the Terms of Service and Use prior to any purchase of this Site. You expressly agree that your use of the service is at your sole risk. The service is provided on an “as is” and “as available” basis.


NESLETTER SIGNUP:

During a Newsletter signup

I don’t appreciate receiving spam and know you don’t wish to either.

During a Newsletter sign up, Siel-art collect the following information: name, and email. When users of my website choose to sign up for our Newsletter they agree to receive information about new artwork, special offers, coupons, website changes and other relevant information about Siel-art.

All of my coustomers can at any given moment choose to unsubscribe or delete their account from the database by logging into their email-account and delete it or unsubscribe at the bottom of each newsletter, it’s that simple – or by contacting Siel-art through this mail – art@sielart.com – then I will make sure it’s done right away.

Mailing lists, and addresses entered into my site’s * email system are never sold, rented, traded, leased, bartered, or otherwise disclosed, without the consent of the subscriber.

Sielart.com visitors who provide public contact information (public email address, phone numbers, addresses, websites, etc.) do so at their own risk. Visitors do not need to provide any public contact information besides email.

Newsletters and mail list are done via the services of Mailchimp.com who complies with all GDPR regulations.


INTELLECTUAL PROPERTY RIGHTS:

You may not reproduce, modify, display or otherwise make commercial use of any content from the Siel-art website (www.sielart.com) unless expressly permitted by Siel-art.

Siel-art reserves the right to refuse service to any individual at its sole discretion. All graphics, images and content on the Siel-art website or social platforms are exclusive to Siel-art only, or its affiliates. The use of any Siel-art trademarks or service marks without a Siel-art written consent, is strictly prohibited.


INTELLECTUAL PROPERTY:

ALL ARTWORK APPEARING ON Sielart.com REMAINS THE INTELLECTUAL PROPERTY OF THE ORIGINAL ARTIST, Christophe Siel.

You do not acquire ownership or proprietary rights to any content, Intellectual Property, document or other materials viewed through the Site. You do not acquire Intellectual Property rights in any item purchased through the Site.

Other product and company names appearing on the site may be trademarks of their respective owners.

You furthermore agree not to change anything or delete any proprietary notices from materials downloaded from my site.


RETURNS AND EXCHANGES:

I of course hope you are very happy with your new item.

However, if it’s not the “perfect match”, you may return or exchange your new item for either a refund or credit note within 14 days, providing they are eligible. Any ineligible goods returned will be refused, so it’s important that you read and understand the following returns information.

To be eligible to return or exchange a Siel Art purchase,

you must be able to answer a BIG FAT NO to all of these questions:

-Has it been 14 days since the receipt of the item?

-Has the item been used?

-Has the item been damaged?

-Is the item damaged, changed in any way?

If you can answer a BIG FAT NO to all of these questions, then you may start the returns process:

A) Firstly send me an email to art@sielart.com regarding your return, so that I am expecting your item and therefor can process it quicker. Don’t forget to write your full name, order number, date of purchase and describe the problem. (PS. optionally place a photo in your mail showing / describing the defect / problem)

B) Pack the item together with your order number plus order name in a legible letter. And if you would like a refund, then write ‘Refund’ in the header of your return letter. If you would like an exchange, then write “Exchange” and state the details of the exchange. Fx. : “Exchange” – I would like (name of new poster / item) instead of (name of the poster / item you received)

For any exchanges I ask that you pay a new shipping fee to cover the cost of reposting the exchanged item back to you. You will be emailed an invoice and will only be sent the exchange once this has been payed.

If you don’t write your exact order number or name, I don’t have any possible way to know that the returned order is yours, so without these vital informations, I will be unable to help you, process your return or exchange.

Once you have completed the above two steps, then place the item(s) and return note in a postage box / tube, and send them to our return address at:

When I receive your returned item, I will let you know and then issue you a refund or an exchange as stated on the piece of paper that you have provided me, in your exchange. Refunds will be given in the same method of payment that they were received and only the item price will be refunded, no delivery costs will be returned as this has already been used by sending you the item.

(Items with free delivery included, will be returned at a discounted rate to account for our delivery costs, incurred to send the item(s) to you.)


CURRENCY CONVERSIONS:

All prices listed on our site are charged in EUROS. The bank that has issued your credit card, determines the exact exchange rate that you will pay, but in general it will match very closely with the going exchange rates. DELIVERY DELAYS:

When orders shipped internationally reach the destination country, they may be subject to customs clearance procedures, which can cause delays beyond original delivery estimates.

Please note I do my best to provide you with a quick and efficient service but sometimes delays can occur. If you are still to receive an item after the estimated delivery date, then please be patient and give it a few more days and your order will be there before you know it.

If you have given it a few days and the situation remains, then just follow these steps:

A) Check the delivery address of your order.

B) Remember to check, that you have not been left with a “mail notice” through your letter box, stating that they have tried to deliver and are holding your package at the post office.

C) It’s also a good idea to check with your neighbors and places around your property for left parcels, and please contact your local post office, to see if your parcel is still in their care.

D) Send me an email to art@sielart.com and I will domy best to solve the situation.

PS. International buyers please be aware that I have no control over local delivery services. Delays may be due to customs checks and handling, slow local delivery services or busy periods of the year fx. Christmas and other important holidays etc.


WORLDWIDE SHIPPING:

After your payment is authorized and verified, your item will be dispatched as soon as possible.

POSTER orders are generally dispatched within 7-12 working days, sometimes shorter, sometimes longer, but since I am a one man business they may take longer, I order, sign, pack and ship the work myself this makes it hard to pinpoint a specific timeframe.

CANVAS orders might take 2-4 weeks due to the unique hand painted and varnished features on the print. It will be printed, signed, painted, varnished and then packed. As of now 9th of april 2021, Canvas orders outside of Denmark will be shipped rolled up in a tube with the wood to mount it. This is the best way to ensure lowest transport fees and a safer shipping. ( This means you’ll need to find a frameshop or a framer near you that can mount it, this is relatively cheap and doesnt take long at all. The framer will have all he needs, the canvas and the wood so he just needs to mount it.) IF you would like the canvas to be shipped already mounted feel free to write Art@sielart.com to discuss this. Shipping fees might be alot higher shipping this way.

Original orders might take up to 2-4 weeks or 1-2 months. Sometimes shorter, sometimes longer as they are a handmade product that needs to be painted. I will of course be in close contact with you and answer all the crucial questions and give you all the informations you need until it reaches your doorstep. This is one of the reasons why original orders are request for price, so we can develop a nice conversation and you get the best experience I can offer! The final product might vary slightly as it will be handpainted with acrylic paint and sometimes spray paint. Other paints might also be used. Streamlining of this might change on a later date.

Furthermore you should receive a shipping notification email, that will notify you when your item is on its way.

Your order will be sent to the address which matches the one in your order info. It’s therefore essential to make sure that your address is complete, and that you use your correct delivery address with your house number, street, postal code and country.

Depending on were you are located, most orders will be delivered by your local postal service. If you are not home when the delivery is made, a notice card may be left by the postal service to advise on how and where your delivery can be collected. If you do not respond to the notice, your package will be returned to Siel-art, and your order will be cancelled. Then a full refund will be processed to your account only when the package is returned and in good and original condition. This whole process may take up to 6 weeks or more and there is no way we can speed this up.


TAXES & DUTIES:

Please be advised that customs charges and / or import duties are determined by the customs office of the destination country. And where it is applicable, it may be delivered once the parcel arrives at the destination country.

The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit card company. Customers outside Denmark will also be liable for any import duty, quotas, permits, product restrictions and other local requirements. You are advised to check latest applicable local requirements before placing an order.

Payment of these charges and taxes is the responsibility of the recipient and will not be covered by Siel-art. For further details of charges and fees, please contact your local customs office.

All applicable customs and import duties and fees, taxes and any other charges and fees are the responsibility of the customer even if you refuse any shipments upon delivery.

These charges are imposed by your local customs. We ship your package DDU, “duties and taxes unpaid”, and we do not collect the VAT, duties and / or taxes and cannot predict what your particular charges may be. These charges differ for every country and every locales. If your order does require these additional charges, they must be paid by you in order for your package to clear customs. Some countries may require additional fees paid Collect on Delivery (COD). Again, these fees are paid to the local customs and are not collected by Siel-art, since we has no control over local customs / import duties. You may call your local customs for more information. ALL CUSTOMS / DUTY CHARGES WILL BE COLLECTED BY Shipping company UPON DELIVERY. The recipient of the shipment is the importer of record in the destination country and is responsible for all Import Fees. If you refuse a shipment from Siel-art, you are responsible for the original shipping charges, any tax / custom duties that are incurred on the package, and also the cost of returning the package to Siel-art or the package will be abandon and disposed by the carrier specified in your shipment with no refund made. In the case of gifts or other purchases made on behalf of another recipient, you also agree to grant the foregoing authorizations on behalf of the recipient designated in your order. To obtain details regarding the Actual Import Fees, or to obtain documentation or receipts in connection with customs clearance, you may contact the Carrier specified in your shipment confirmation e-mail. If you refuse a shipment from Siel-art, you are responsible for the original shipping charges, any import fees that are incurred on the package, and the cost of returning the package to Siel-art. This amount will be deducted from your merchandise refund.


WARRANTY DISCLAIMER:

I can not guarantee that the colours shown on www.Sielart.com are a 100 per cent reproduction of the colours of my original products shown through your phone or computer screen. The appearance of the colours may vary slightly, depending on the specific computer setup.

Claims will be handled in accordance with Danish legislation. Which gives you a 24 months warranty on all merchandise. This warranty means that as a customer you can make claims on defects and faults of the purchased up to a period of 24 months after the purchase. However, it is a precondition that the errors have not been caused by misuse of the product or any other harming conduct. The claim must be made within a reasonable time after you have registered the defect or fault.

Being the customer you can demand a new product, provided that the claim is justified, that the exchange of the product will not cause unreasonable costs for sielart.com, and that the claim in any other way is possible to fulfil. If the product cannot be replaced, you will be entitled to a money refund.

The limited art prints on siel-art are provided “as it is” and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, siel-art disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. Siel-art does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Siel-art does not make any warrantees or representations regarding the use of the materials on this site, in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise.

PS. Some states or nations doesn’t permit limitations or exclusions on warranties, so the above limitations may not apply to these states or nations.


IDEMNIFICATION

Every user of Sielart.com agree to indemnify, defend, and hold harmless Siel-art its directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing our site


THIRD-PARTY LINKS:

In an attempt to provide increased value to Sielart.com visitors, Siel-art may link to sites operated by third parties. However, even if the third party is affiliated with Siel-art, we have no control over these linked sites, all of which have separate privacy and data collection practices, independent of Siel-art, these linked sites are only for your convenience and therefore you will access them at your own risk. Never the less, Siel-art always seeks to protect the integrity of our site and the links placed upon it, we therefore welcomes any feedback on not only our own site, but for sites we link to as well (fx. if a specific link does not work)


TYPOGRAPHICAL ERROS:

In the event that a Siel-art product is mistakenly listed at an incorrect price, Sielart.com reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Siel-art reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Siel-art will of course issue a credit to your credit card account, in the amount of the incorrect price.


COOKIE INFORMATION AND DATA:

Depending on how you’re accessing Siel-art, I may use “cookies” (small text files sent by your computer each time you visit our website, unique to your browser) or similar technologies to record log data. When I use cookies, I may use “session” cookies (that last until you close your browser) or “persistent” cookies (that last until you or your browser delete them). Some of the cookies I use are associated with your NEWSLETTER (including information, such as the email address you gave me), and other cookies are not.
